1Agreement to these terms
designwhere is an online guide to design places, events and experiences, available at designwhere.app and through any related pages we operate (the Service).
By using the Service you agree to these Terms of Use. If you do not agree with them, please do not use the Service.
We may update these terms from time to time. When we do, we change the date shown at the top of this page, and material changes are announced on the Service before they take effect. Continuing to use the Service after a change means you accept the updated terms.
2Who can use the Service
You may browse the Service without an account. To save places, submit an RSVP or apply to become a partner, you need to create an account.
- You must be at least 18 years old, or have the consent of a parent or guardian where the law allows it.
- The details you give us when you register must be accurate and kept up to date.
- You are responsible for everything that happens under your account, so keep your password to yourself.
- Tell us straight away if you believe someone else has used your account.
We may suspend or close an account that breaks these terms, or that we reasonably believe is being used to mislead other people.
3Accounts, partners and plans
A partner account can publish places, events and experiences on the Service. Partner access is granted after we review an application; we are not obliged to accept every application, and we may ask for supporting documents before deciding.
Partner plans differ in how many listings they include. The plan you choose, its price and its billing period are shown to you before you confirm it.
Payments
- Prices are shown in the currency displayed at checkout and include applicable taxes unless stated otherwise.
- Paid plans renew automatically at the end of each billing period unless cancelled beforehand.
- You can cancel at any time; cancellation takes effect at the end of the period you have already paid for.
- Except where the law requires it, payments already made are not refundable.
Replace this section with the terms your payment provider and local consumer law require — in particular the cancellation window, refund rules and how price changes are announced.
4Listings and partner content
Partners are responsible for everything they publish: names, descriptions, addresses, opening hours, dates, prices, photographs and any other detail of a listing.
By publishing a listing you confirm that:
- the information is accurate and you keep it current;
- you hold the rights to the photographs and text you upload, or have permission to use them;
- the listing does not infringe anyone else's rights and does not break any law that applies to it;
- where a listing sits inside a venue you do not operate, you are entitled to list an activity there.
Every listing is reviewed before it goes live. A review is a basic editorial check, not a guarantee of accuracy, quality or safety. We may edit, decline, unpublish or remove a listing at our discretion, in particular where it is misleading, incomplete or the subject of a complaint.
You keep ownership of the content you upload. You grant us a non-exclusive, worldwide, royalty-free licence to host, resize, display and promote that content in connection with the Service, including on our social channels and in newsletters. This licence ends when the content is removed, apart from copies kept in backups or where we are required to keep them.
5Events, experiences and bookings
Events and experiences are organised by the partner who publishes them, not by us. Any RSVP, request or ticket purchase creates a relationship between you and that partner.
- Attendance rules, age limits, accessibility, cancellations and refunds are set by the organiser.
- Where an RSVP requires approval, the organiser decides whether to accept it.
- Where tickets are sold through a third-party payment page, that provider's terms also apply.
We are not a party to those arrangements and do not act as an agent for either side. If something goes wrong with an event, please contact the organiser first; you can always let us know as well.
6Acceptable use
When you use the Service, please do not:
- publish anything unlawful, misleading, hateful, harassing or invasive of someone's privacy;
- impersonate another person, business or venue;
- upload photographs you do not have the right to use;
- collect data from the Service by automated means without our written permission;
- attempt to break, overload or gain unauthorised access to any part of the Service;
- use the Service to advertise products or services unrelated to design.
If you come across content that breaks these rules, write to us at the address at the bottom of this page and we will look into it.
7Our content and trade marks
The Service itself — its design, code, maps interface, editorial text, logo and name — belongs to us or our licensors and is protected by intellectual property law.
You may link to the Service and share individual pages. You may not copy, adapt or republish substantial parts of it, or use our name or logo in a way that suggests an endorsement we have not given, without our written permission.
Map data and imagery come from third-party providers and remain subject to their own licences and attribution requirements.
8Third-party links and services
The Service links to websites we do not control — partner websites, social profiles, map providers, ticketing and payment pages. We include those links for convenience and are not responsible for their content, their practices or their availability.
Once you leave the Service, the terms and privacy policy of the site you are visiting apply.
9Availability and changes
We work to keep the Service available, but we do not promise that it will be uninterrupted or error-free. We may add, change or withdraw features, and we may suspend access for maintenance or for reasons outside our control.
Where a change materially reduces what a paid plan includes, we will tell affected partners in advance.
10Disclaimers
The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties about the accuracy, completeness or reliability of listings, opening hours, prices, coordinates or any other information published by partners.
Please check details with the venue or organiser before you travel.
Replace this section with wording that matches the law of the country in the Governing law section below — disclaimer clauses are read narrowly in many jurisdictions.
11Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, loss of data, or loss arising from a wasted journey, a cancelled event or a listing that turned out to be inaccurate.
Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.
Replace this section — add the liability cap you intend to rely on, for example the amount paid in the twelve months before the claim.
12Suspension and termination
You may stop using the Service at any time and ask us to close your account.
We may suspend or close an account, remove listings, or withdraw partner access where these terms are broken, where we are required to do so by law, or where keeping the account open would create a risk for other users. Where it is reasonable to do so, we tell you why beforehand.
Sections that by their nature should survive termination — content licences already granted, disclaimers, liability and governing law — continue to apply.
13Governing law and disputes
These terms are governed by the laws of [country / emirate], and the courts of [city] have exclusive jurisdiction over any dispute arising from them.
If you are a consumer, this does not remove the protection of the mandatory laws of the country where you live.
Replace the bracketed placeholders with the jurisdiction your company is registered in.
